What exactly is elder law? The "People's
Law Dictionary" defines it as:
elder law
(n.) a specialty in legal practice, covering
estate planning, wills, trusts, arrangements for care, social
security and retirement benefits, protection against elder abuse
(physical, emotional and financial), and other concerns of older
people. As more people live longer it has become an increasingly
important field.
Ms. Knauerhase can help with all of these issues, both
for advance planning (arranging things before you need
them) and at-need (when something happens
to you or your family). She will use her experience and
knowledge to help you carry out your wishes, while obtaining all
the benefits available to you under the law.
Among the services she can provide are:
-
a basic will — describing how your
property and assets should be distributed, and how minor
children should be provided for after your demise
- trusts — to provide for specific bequests
and to obtain a more favorable tax situation upon your death
- a durable power-of-attorney (POA) — so
loved ones can manage your affairs should you be incapacitated
- a health care POA — to express your wishes
about how you'll be cared for (life support, tube feeding,
etc.)
- beneficiary planning — for insurance policies, IRA accounts, and so forth;
including describing the tax treatment of different choices
- gifting advice — legal options to transfer
assets to family while qualifying for Medicare/Medicaid;
charitable giving and its effect on taxes before and after
death
- a guardianship or conservatorship —
designating someone (a family member or a lawyer) to manage
your affairs
- retirement planning — working with other
professionals (CPA, tax advisor) at many stages in your life
- probate and estate administration —
guiding a personal representative (executor of a will) through
the probate process, or acting as your representative when
needed
